Environmental due diligence protects the purchaser and lender from costly environmental issues which may be identified during an environmental site assessment.
The property may look good today, but the environmental site assessment will also investigate prior uses of the property back to 1940 or first developed use which often identify historical uses that represent an environmental concern, such as dry cleaners or gas stations.
The Phase II recommendation should not be disregarded, but some consultants make the recommendation too quickly. A second opinion regarding the risk is a good idea. If necessary, the Phase II will identify the actual risk and should be sufficient to provide remedial solutions.
